Thank you for choosing to participate in our programs. We are committed to providing a safe, respectful, and legally clear environment for all our students. This Participant Agreement (the "Agreement") is a standard part of our commitment to you and to our community.
Please read this entire Agreement carefully before registering for any program. By registering for, accessing, or participating in any program, class, event, or service offered by Center and Ground Collective ("CGC," "we," "us," or "our"), you ("Participant," "you," or "your") agree to be bound by the terms of this Agreement.
THIS AGREEMENT INCLUDES A RELEASE OF LIABILITY AND AN ASSUMPTION OF RISK. IT AFFECTS YOUR LEGAL RIGHTS.
CGC offers a variety of Programs designed for applied mindfulness and wellness. These Programs may include, but are not limited to: meditation, sound healing, tai chi, coaching, counseling, support groups, self-paced challenges, and courses on specific topics such as parental guidance for internet and screen use, and the development of telepathic communication skills with animals.
Important: Our Programs are educational, experimental, and subjective in nature. They are not a substitute for professional medical, psychological, legal, or financial advice, diagnosis, or treatment. CGC and its facilitators are not acting as licensed therapists, counselors, physicians, or veterinarians.
By participating in CGC Programs, you acknowledge that there are inherent risks, which may include:
General Risks: Emotional, psychological, or physical discomfort or distress.
For Aware Parents Support Group: CGC is not responsible for the actions, decisions, or outcomes of any family member's internet use. The information provided is for educational and support purposes only, and it is solely the responsibility of the parent or guardian to determine what is appropriate for their own family.
For Telepathy with Animals: The practice of telepathy is subjective and experimental. CGC does not guarantee that any Participant will develop or achieve any specific skill, result, or outcome. The efficacy of the course is dependent on numerous individual factors, and CGC is not liable for any perceived lack of progress or success.
For CT Grad On Demand: This program consists of pre-recorded materials to be completed as a self-directed challenge. The content is provided "as is." You acknowledge the inherent limitations of a pre-recorded, self-paced format, including the absence of a live instructor for immediate guidance.
General Wellness: As is the case with any physical activity or wellness practice (e.g., meditation, sound healing, tai chi), the risk of injury or discomfort is always present.
By participating in CGC Programs, you voluntarily assume full responsibility for any and all risks, injuries, or damages, known or unknown, that you might incur as a result of your participation. You represent and warrant that you are physically, mentally, and emotionally capable of participating in the Program and will consult with a licensed healthcare professional if you have any concerns.
To the fullest extent permitted by law, you, on behalf of yourself, your heirs, assigns, personal representatives, and next of kin, hereby release, waive, discharge, and covenant not to sue CGC, its owners, directors, officers, employees, agents, instructors, facilitators, volunteers, affiliates, and successors (collectively, the "Released Parties") from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury (including death), or other harm that may be sustained by you. This includes, but is not limited to, claims arising from the negligence of the Released Parties or from the actions or omissions of other participants.
You agree to indemnify, defend, and hold harmless the Released Parties from and against any and all costs, claims, damages, liabilities, or expenses (including reasonable attorney's fees) arising out of or related to your actions, breach of this Agreement, or participation in the Programs.
You understand that all or portions of CGC Programs may be recorded via video, audio, or photograph.
By participating, you grant to CGC, its affiliates, and assigns, a non-exclusive, perpetual, worldwide, royalty-free, and irrevocable license and right to record, reproduce, edit, modify, exhibit, publish, distribute, and otherwise use your name, image, likeness, and voice in any and all media now known or hereafter developed, for any lawful purpose. This includes, but is not limited to, creating promotional materials, marketing, educational content, and for sale or resale to other students as part of an archived course or new program.
You waive the right to inspect or approve the finished product(s), the right to any royalties or other compensation, and any claims for invasion of privacy, defamation, or other claims arising out of or related to such use.
You acknowledge that CGC's instructional methodology, coaching techniques, proprietary materials, and course content are proprietary and confidential. You agree not to copy, reproduce, distribute, or use any such materials or methodologies for any purpose other than your own personal growth and learning, without the express written consent of CGC. This includes a prohibition on recording any portion of a program for personal or commercial use. You may discuss your personal experiences but may not share, sell, or redistribute CGC's content.
CGC reserves the right to modify or cancel any Program offering at any time. In the event of cancellation by CGC, participants will be offered a full refund or credit toward a future Program.

This Agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any legal action arising out of or related to this Agreement or the Programs shall be brought exclusively in the state or federal courts located in Alameda, California, and you consent to the personal jurisdiction of such courts.
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
This Agreement constitutes the entire agreement between the parties and supersedes all prior agreements or understandings, whether written or oral.
The failure of CGC to enforce any provision of this Agreement shall not be deemed a waiver of such provision or any other provision.
By registering for a Program, you acknowledge that you have read this Agreement, fully understand its terms (including the release and waiver of liability), and agree to be bound by its terms freely and voluntarily.
You affirm you are at least 18 years of age or, if under 18, that a parent or legal guardian has reviewed and consented to this Agreement on your behalf.
